The City of Thornton <br />offers the following comments on the application. <br />The City of Thornton has filed a Complaint in Condemnation for the subject <br />property in Case No. 98CV1177, Adams County District Court. Thornton <br />intends to acquire the subject property, or portions thereof, for development <br />into a water storage facility to serve the needs of Thornton's municipal water <br />system. This represents a material fact that should be included in the <br />application and permit documents. <br />2. The proposed reclamation plan should not contain requirements that would <br />interfere with Thornton's eventual use of the property for water storage. <br />3. The proposed reclamation plan should contain terms and conditions that can <br />accommodate the structures and facilities necessary for eventual use of the <br />subject property as a water storage facility. <br />4. The proposed reclamation plan should not contain requirements that would <br />frustrate the exercise of water rights owned by Thornton. <br />5. Acquisition of the subject property by Thornton may result in a different <br />operator than the applicant. <br />6. Information contained in the Public Notice stating future land uses of <br />Developed Water Resources (WR), Wildlife Habitat (WL) and Recreation <br />(RC) conflicts with the information contained in item 10 of the application. <br />Future land uses of Wildlife Habitat and Recreation may be incompatible with <br />the Developed Water Resource use. <br />"The City of Planned Progress" <br />
