Dear Mr. Mount:
This letter is intended to convey written comments and objections to the
Construction Materials Regular (112) Operation Reclamation Permit Application
submitted by CAMAS Colorado, Inc. for Permit # M-99-034. The City of Thornton
offers the following comments on the application.
The City of Thornton has filed a Complaint in Condemnation for the subject
property in Case No. 98CV1177, Adams County District Court. Thornton
intends to acquire the subject property, or portions thereof, for development
into a water storage facility to serve the needs of Thornton's municipal water
system. This represents a material fact that should be included in the
application and permit documents.
2. The proposed reclamation plan should not contain requirements that would
interfere with Thornton's eventual use of the property for water storage.
3. The proposed reclamation plan should contain terms and conditions that can
accommodate the structures and facilities necessary for eventual use of the
subject property as a water storage facility.
4. The proposed reclamation plan should not contain requirements that would
frustrate the exercise of water rights owned by Thornton.
5. Acquisition of the subject property by Thornton may result in a different
operator than the applicant.
6. Information contained in the Public Notice stating future land uses of
Developed Water Resources (WR), Wildlife Habitat (WL) and Recreation
(RC) conflicts with the information contained in item 10 of the application.
Future land uses of Wildlife Habitat and Recreation may be incompatible with
the Developed Water Resource use.
