P. has submitted exploration plans to the Bureau of Land <br />Management for coal exploration drilling adjacent to and west of the Colowyo Mine in the <br />Danforth Hills. I am also preparing a Notice of Intent and Permit Information for approval from <br />the Colorado Division of Minerals and Geology (DMG). <br />The DMG requires, as a part of their approval process, a statement regarding listed <br />threatened or endangered species in the area of the exploration program. The DMG <br />requirement is stated as follows: <br />Attach a statement with appropriate references from the relevant State or <br />Federal agencies or published sources, which determines that the exploration <br />and reclamation described will not jeopardize the continued existence of an <br />endangered or threatened species listed pursuant to Section 4 of the <br />Endangered Species Act of 1973 (16 U.S.C. 1533) or the Nongame, <br />Endangered or Threatened Species Conservation Act (Section 33-8-101 et seq. <br />C.R.S. 1973) or result in the destruction or adverse modification of critical <br />habitat of those species, (Rule 2.02.212)Ih)) <br />The proposed exploration program will require 92 drill locations to be constructed. A <br />disturbance of approximately 0.034 acres per site is anticipated. Access road construction <br />will be required at 56 drill locations.• Of the 56 locations requiring road construction, 33 will <br />require a minimal amount of brushing to construct the road, and 23 sites will require topsoil <br />removal and cut/fill type construction methods. Disturbance acreage for various activities is <br />estimated as follows: <br />Drill site disturbance - 4 acres <br />e Brushed road disturbance - 10 acres <br />e Cut/fill road disturbance - 18 acres <br />
