Wir~gerson pointed oui that three actions appear possible: that the Commission can recommend to <br />ullou the proponent to follow the stipulations of a minor impact, and so risk a suit, by neighbors an the basis of <br />procedure; the commission could let the eristir~g decision stand as is ar~d the neighbors could seek to turn ii <br />over in court; the Commission could ask the Board to invalidate the existing decision and so risk. a suit by the <br />proponent. <br />Discussion ensued and the following motion was made: <br />DICK WINGERSDN MDVED and Morry Esmiol seconded a motion +.hat the Planning Commission accept the proponent's <br />request for stipulation to comply with the Land Use kesolution requirements far a minor impact. The Planning <br />Commission Finds that these changes will only hove the result of reducing possible impacts and will therefore riot be <br />basis for changing the recommendation of April b, 1985. <br />THE MDTIDtI PASSED 3-2, with Morry Esmiol, Don Crosby and Stan Smock voting in its favor, and Dick Wingerson <br />nrrd Linda Helken voting against it. <br />PAGE 2 <br />
