RECEIVED
ppR 3 fl 2001
Dip m1n9 a d Sa ery '
Apri126, 2007
Ms. Kelly Morgan
Colorado Department of Public Health and Environment
Water Quality Control Division
4300 Cherry Creek Drive South
Denver, CO. 80246-1530
RE: COLOWYO COAL COMPANY L.P. (COLOWYO); CDP$ NO. CO-00045161
SETTLEABLE SOLIDS REPORTED DATA MODIFICATION REQUEST.
Deaz Ms. Morgan,
During the course of District Engineer Andrew Poirot's inspection recently, he noticed that Colowyo was
appeazing to report settleable solids (SS) concentrations which were above the permitted limit. Colowyo
investigated the matter and determined that when IML took over sample analyses duties from ACZ
Laboratories between Mazch and April, 2005 they failed to enter the correct method minimum detection
limit on Colowyo's analysis reports. The method used in this case measured SS concentration down to the
0.2 ml/L level and made it's determination ofnon-detection at that concentration, not at the 1.0 ml/L level
that is implied by their laboratory reports. As a result of Colowyo's policy of reporting the minimum
detection limit in instances of ND (non-detectable) results from laboratory analyses, values of "<L0" were
entered on all subsequent reporting forms begi aning with the second quarter 2005 through the fourth quarter
2006., As a result of this investigation, the con•ect method minimum detection limit of "0.2" will be added
to future laboratory analysis reports and IIvff, reprinted and sent to Colowyo connected laboratory reports
from April, 2005 through Mazch, 2007.
Colowyo has attached corrected copies of the DMR reports from the time period in question and requests
that the corrected values of "<0.2" be entered into the system to replace the "<].0" values reported in error.
It should be noted that SS concentrations during that time period were never detected above the 0.2 ml/L
concentration level, suggesting that the outfalls aze functioning well, especially during instances when
Colowyo is allowed to use alternative criteria during and within 48 hours of detectable precipitation and
stormwater inflow into the outfall structures. Also important to know is the fact that no current outfall
locations at Colowyo involved in waiver requests during April, 2005 through December, 2006 received any
process water from the operation, and all loading resulted from stormwater/meltwater activity.
Thank you for your consideration. Please feel free to contact me if you have any questions or concerns. I
can be reached at (970) 824-1531.
Sincerely,
Kurt~Blunt
Environmental Engineer
Encls.
C: CDMG/James S. w/encl
WQCD/Mdrew P. w/encl
IdPDES Reports Binder w/encl C.F. 21.1.2 w/encl
Colowyo Mine • 5731 State Highway 13 • Meeker, Colorado 81641
T +1 970 824 1500 • P +1 970 824 1504 ~ www.rtea.com
Kurfis R Blunt
Environmental Engineer
