The identified wells are located along the drainage <br />divide between the Arequa Gulch and Bateman Creek drainages. The purpose of the proposed <br />confirmation and commitment is, as CC&V understands it, for CC&V to restate that CC&V <br />intends to continue to operate in accordance with its authorizations. These authorizations include <br />operating in a manner that protects ground-water quality beneath the ephemeral surface water <br />course designated as "Bateman Creek," a minor first order tributary of the Wilson Creek <br />watershed, from degradation attributable to CC&V's operations -degradation that would <br />adversely affect reasonable uses of that water. <br />CC&V, through this letter, reiterates that it is monitoring, and that it will continue (unless it <br />receives an approval to do otherwise) to monitor the quality of water that enters ground-water <br />wells [hat it presently monitors in association with its authorizations from the Office of Mined <br />Land Reclamation. CC&V does not agree that this reiteration, or statement, is a technical <br />revision of the permi[ and respectfully declines to have it considered such. As you are aware, <br />CC&V is now, and always has, monitored water quality in these wells in accord with the <br />conditions that have been imposed by the Office. Therefore, nothing is being "revised." <br />The nvo wells that have been installed along the Arequa Gulch -Bateman Creek drainage divide <br />and which are specifically addressed here are designated "WCRM-2" and "WCRM-9." Well <br />WCRM-2 was installed by CC&V as part of the investigations performed for an early version <br />of "Amendment Number 5" to the referenced permit. Well WCMW-9 was installed in direct <br />
