Cottony <br />Division Director <br />Natual Resource Trustee <br />The Division of Reclamation Mining and Safety, has reviewed your 110 permit application for Buffalo Stone <br />Limestone quarry and has the following comments. <br />I) Exhibit "A" Legal Description/ <br />A) The legal description in the location map and the description provided in Exhibit "A" do not <br />correlate, please explain. <br />In Exhibit "B" Site description. <br />A) Under 6.3.2(b), the operator has identified only one man made structure, a stock pond <br />approximately 100 feet west of the Buffalo Stone quarry. The Mineral rule requires the <br />operator to either provide a notarized agreement with the owners of the stock pond or provide <br />an engineering study to show that the operation will not adversely impact the structure or stay <br />200 feet from the pond. Please explain. <br />II)) Exhibit "C" Mining Plan 6.3.3 <br />A) It is the understanding of the Division that the high wall will not exceed 15 feet in height and <br />slopes will be cut to 3:1 or gentler. <br />B) It is also the understanding of the Division that the quarry slopes will consist of bench faces <br />approximately 2 feet in height with bench widths of approximately 6 feet. <br />C) Under 6.3.3 (h), you stated that "water for dust abatement is not anticipated to be needed for <br />the quarry". However, under6.3.3(j), you stated " if needed, water used at the operation will <br />be obtained and truck hauled from sources in the azea that have Colorado Water Rights". <br />Please Explain. <br />D) Under 6.3.3 (i) water management, you stated, "there are no springs or known aquifers <br />&don't anticipate intercepting ground water. A C.D.P.H.E storm water permit will not be <br />needed because you plan to develop the site to retain all storm water runoff in the affected <br />azea. <br />IV) Exhibit "D" Reclamation Plan 6.3.4. <br />A) It is the understanding of the Division from the application that all the affected azea will be <br />reclaimed as outlined in [he Exhibit. All available top soiUgrowth medium will be salvaged <br />which ranges in thickness from 4 inches to 14 inches an will be seeded as recommended by <br />the local N.R.C.S until used in reclamation. <br />B) The Division has reviewed your warranty calculation under 6.3.4(2) and has included a <br />detailed warranty calculation based on the information you provided for your review.
