We thank you for your review of the above <br />referenced application and its attadred and additional documents. We are attaching a ~ of our <br />March 6, 2002 letter for use as referer>ce to the fdla~ving. <br />With respect ro the atlacfled "Exhitits° ro the March 6, 2002 letter. These "Exhibits" are designed ro be <br />altadled to the letter, and do rrot reflect a referenced Exhibit attadled to the original application. We <br />darify this in paragraph one of the letter. If it hest meets your needs to re-title these exhibits to match <br />that of the origirr~ application, then we agree to same. <br />"Exhibit A -Legal Description (Rule 6.4.1): <br />The metes and bounds legal description provided as an attachment to the original application and <br />Exhibit AA altadted to the letter of March 6, 2002 is the correct legal description for this project. This <br />description denotes the effected, and/or excavated area that is to be permitted under this application for <br />a 112 permit. No other area is to be permitted as the effected and/or expvated arm. In general, this <br />is the area shown via the dark dads lines on the maps attached to the March 6, 2002 Inter. You will <br />note to the west end of the effected area the actual boundary Celled out in the rn~es and bounds <br />description and the dark blade lines of the drawdrgs are not the same. A small set bade area exists at <br />this location to meet Iocal Courriy LUR requirements. This having been said, we reconfirm that the <br />mimes and bounds description is to be the permitted area. <br />F~rhibit C -Pre-rrining and Mining Maps (Rule 6.4.3): <br />We understand your nced to label the maps attached ro air letter of March 6, 2002. We agree to the <br />change in labels. <br />Paragraph two of page 2 of your letter. We reconfirm that the pemritted area is to consist of the metes <br />and bounds description area. <br />Paragraph 3 of page 2 of your letter. As called out in air letter of March 6, 2002. All set bade areas <br />shown on the maps attached ro the March 6, 20021etter are to remain urxtisturbed during the entire life <br />of the mining operation. The effected and/or excavated area is that which is called out in the rides and <br />bounds description area. All excavation and processing operation shall take place with in this metes <br />and bounds description area. Prior to any operation taking place at the effected (permitted) area, said <br />area will be dearly marked with 4x4 rbmer posts at all comers. <br />
