BANTA, Dlreator <br />December 24, 1987 <br />Mr. John Wiggins <br />109 Madison Street <br />Wallenberg, Colorado 81089 <br />Re: Trinidad Basin Mine <br />Dear Mr. Wiggins: <br />This is a follow up letter to your questions expressed in our December 23, 1987 <br />phone conversation. Effective November $, 1987 the two (2) acre exemption no <br />longer applies in Colorado. This is due to the passage of Feaeral Law 100-34 <br />which effectively prohibits the twa (2) acre exemption in arty state. The <br />reason apparently was because of some abuses of the,exeltption back east. At <br />this point you need to apply for a permit unless the extraction is less than <br />250 tons or for nonprofit private use. <br />The Trinidad Basin mine asyou know is inactive. The permit for the mine was <br />suspended by the Mined Land Reclamation Board due to a pattern of violations <br />at the site on November 14, 1984. Subsequently, the permit expired on <br />December 13, 19$7. This means that there is no valid existing permit for the <br />mine for you to take over. <br />A new permit could be obtained using information from the old Trinidad Basin <br />application but it would need to be updated. The permit process takes from <br />three (3) to twelve (12) months or more with the average time of six (6) <br />months if ail information is readily available. <br />If you disire to obtain a permit we would suggest you meet with us to discuss <br />information requirements.
