3. Noncompliance Notification
a) If, for any reason, the permittee does not comply with or will be
unable to comply with any mazimum discharge limitations or
standards specified in this permit, tb"e permittee shall, at a
minimum, submit in writing to the Water Quality Control Division
and EPA within five days of becoming aware of such conditions, the
following information: -
i
(i) A description of the discharge and cause of noncompliance;
i
(ii) The period of noncompliance, including ezact dates and
times and/or the anticipated time when the discharge will
return to compliance; and
(iii) Steps being taken to reduce, eliminate, and prevent
recurrence of the noncomplying discharge.
b) The permittee shall report the following instances of
noncompliance orallq within twenty-four (24) hours from the time
the permittee becomes aware of the noncompliance, and shall mail
to the Division a~report within five (S) days after becoming aware
of the noncompliance:
(i) Any instance of noncompliance which may endanger health or
the en;iironment;
(11) Any ~ianticipated bypass;
(111) An~upaet which causes an ezceedance of any effluent
1 mitation in the permit;
(iv) /Any spill which causes any effluent limitation to be
violated;
(v) Da11y mazimum violations for any tozic pollutants or
hazardous substances limited by PART I-A of this permit
and specified as requiring 24 hour notification.
c) Tk~e permittee shall report all other instances of non-compliance
of reported under A.3(a) or A.3(b) at the time Discharge
~Moaitoring Reports are submitted. The reports shall contain the
same information listed in sub-paragraph (a).of this section.
