Monte Pascoe, Executive Director
MINED LAND RECLAMATION
423 Centennial Building.1373 Sherman Street
Denver, Colorado 80203 Tel. (30$) 866-3567
David C. Shelton
Director
April 26, 1982
Mrs. Bertha Powell
Powell Construction Co.
P. O. Box 179
Fort Garland, Colorado 81133
RE: Powell Constriction Co. Pit - File no. 77-53
Dear Mrs. Powell:
On April 21, 1982, the Mined Land Reclamation Board approved your request
for a continuance of consideration of your application for a mining and re-
clamation permit for the above captioned operation. This matter is now
scheduled for the May 26-27, 1982 meeting of the Board.
As I mentioned to you, I will be on annual leave from the afternoon of
April 30th until my return the morning of May 20th_ If I do not receive
your reply to my letter of April 2nd before I Leave, I will plan to review
your reply upon my return and call you if I have any further questions.
I am enclosing two forms with this letter. One is a performance warranty
that basically is just a pledge fror_ you that you will do the reclamation
as we are now deciding in your permit. This form you simply fill out your-
self, adding the Iega1 description (to the nearest quarter quarter section)
as it will appear in your permit as "Exhibit A". The second form is a
financial warranty form to be used with a certificate of deposit. You
should either get a new certificate of deposit and use it in conjunction
with this form, or use the form with your existing C.D. Again, you fill
this form out yourself and send it in to our Division together with the
certificate of deposit as your financial warranty. These forms should then
be sent to our Division (along with the certificate of deposit). The
amount of financial warranty that I plan to recommend to the Board will be
$2,500.00, as we discussed.
The Board can consider and approve the application before the warranties
have been received. In fact, the Board has to approve the amount of the
warranty at the meeting. Bo[vever, I feel sure that they will approve my
recommendation. Therefore, if you wish to begin to prepare these forms,
you may do so. in any case, the zeceipt and approval of these warranties
by our Division will be the final thing that has to occur before your permit
will be issued,
In my absence, please feel free to call either Pete Evans or Mike Stanton.
Sincerely,
Mark S. Loye
Senior, Reclamation Specialist
