PART I <br />Page No. 3 <br />Permit No. COG-8500tXI <br />A. COVERAGE UNDER THIS PERMTI' <br />This general permit authorizes dischazges that consist entirely or principally of precipitazion-induced surface runoff from <br />coal mining and processing operations including loadouu, while active mining is occurring or during reclarttazion prior to <br />final bond release, into waters of the State of Colorado. If additional sources which the Division determines [o be minor <br />in nature such as selected mine water, preparation plant water, spoils spring water or other wastewater tray be <br />discharged, these sources may be covered under this permit at the Division's discretion providing that such wastewater <br />would not require effluent limitations and/or monitoring regtriremeau other than those contained in this permit. Such <br />determinations will be made on a case-by case basis upon review of the permit application and any additional relevant <br />information. If discharge from one or more of the above listed sources require additional limitations and/or monitoring <br />requirements, an individual permit may be required. Multiple discharge points from one facility may be authorized <br />through this permit providing all meet these criteria. <br />2. In order to apply for certification under this general permit, the owner, operator, and/or authorized agent of the subject <br />facility shall submit by certified trail or hand delivery, the completed Coal Mining Wastewater Dischazge Application <br />(famished by the Division) which generally requires the following information (at a minimum): <br />a. Name, address, and descriptive location of the facility; <br />b. Name of principal in chazge of operation of the facility; <br />c. Name of immediate receiving waters, (including irrigation ditches, intermittent streams and dry drainage, as <br />applicable); <br />d. Description of the type of activiry(ies) resulting in the dischazge, including We anticipated duration of the activity <br />and/or the discharge, anticipated volume and rate of discharge, and the source(s) of water to be discharged; <br />e. Description of any wastewater treatment system(s) and recyclelreuse utilized; <br />f. A topographic SYs x 11 inch map showing the general gwgraphical location of the facility and any nearby landfills, <br />mine or mill tailings, or any other known or suspected sources of pollutanu; <br />g. An 8Yr x I1 inch sketch of the facility showing all structures, outfalls and receiving waters, as well as storage <br />locations of any petroleum or chemicals on site; and <br />h. A chemical analysis of the wazer to be discharged. If no water is available, this shall be indicated. <br />If the discharge is to a storm sewer system, ditch or outer maamarte conveyance, approval from the owner of the system <br />must be obtained prior to discharge. <br />A[ least 30 days prior to the anticipated date of dischazge, such information shall be submiaed on the application form <br />to: <br />Colorado Departmem of Public Health and Environment <br />WQCD-PE-B2 <br />4300 Cherry Creek Drive South <br />Denver. CO 80222-1530 <br />The Division shall have up to thirty days after receipt of the above inforrrrazion to request additional data or deny the <br />authorization to dischazge. Upon receipt of additional information, the Division shall have an additional 30 days to issue <br />or deny authorzation to dischazge. If the applicant does not receive a request for additional information or a notification <br />of denial from the Division within thirty days, authorization to discharge in accordance with the terms and conditions of <br />the permit shall be deemed granted. <br />If the Division determines that a new facility does not fall under the authority of the general permit, then the information <br />received will be processed for an individual permit and discharge will not be allowed until 180 days afrer the date the <br />application waz received. The applicant shall be notified of such a determination. [f doting the renewal process, the <br />Division determines the[ a facility no longer qualifies for the genera! permit, the facility will be allowed to discharge <br />under the general permit until an individual permit is issued. <br />3. Authorization [o dischazge under this general permit shall expire oa June 30. 2002. 1'he Division must evaluate this <br />general permit once every five years and must also recertify all applicants' authority to discharge under the general <br />permit at such time. Therefore, a permittee desiring continued coverage tinder the general permit must reapply by <br />Jtmuaty 1. 2002. the Division will determine if the applicant continues to operate tinder tetras of the general permit. <br />
