Cattany
Division Director
Natural Resource Trustee
The Division has received your notice of intent to explore (NOI), received by the
Division on 27 October 2006, has assigned the designation of CX-2006-109-13 and has
made the following findings:
1. The application is incomplete; the Division has one request concerning surface
ownership.
2. The project qualifies as coal exploration rather than coal mining.
3. Your project will substantially disturb the natural land surface. The Division is in the
process of calculating a bond liability total for the project as requested by Rio Tinto.
The question involves the map provided with the exploration application. The applicant
notes that not all the surface is owned by RTEA. Please add to the map at least those
azeas not owned by the applicant.
One further comment regazds the bond estimate. Those holes drilled in areas planned for
mining must still be bonded for abandonment. The rationale is that, if the applicant
ceased operation before the holes were mined through, the Division would have to
abandon those drillholes.
If you have any questions, please feel free to call me at 303-866-4928.
Sincerely,
G~"
Jim Burnell
Environmental Protection Specialist
Office of Office of
Mined Land Reclamation Active and Inactive Mines
