Carla Lznskv <br />NOTIFICATION FOR iV1AY 1,1999 DISCHARGE <br />May 10,1999 <br />GROUNDS FOR CLAIMING UPSET CONDITION <br />(i) As explained above, the upset condition was the result of a breach (failure) in the clay <br />limns of the constructed treatment cell. <br />(ii) The ~trzatment cell had been regularly inspected for hazardous conditions. The <br />treatment cell was constructed using generally accepted construction techniques. <br />(iii) Colowyo made the first notification within twenty-four hours of the event and this <br />notice was submitted as required by Part II.A.4. <br />(iv) Colowyo undertook immediate efforts to correct the situation, and minimize the impacts <br />of the unanticipated discharge. <br />GROUNDS FOR CLAID4ING UNANTICIPATED BYPASS <br />Because of the breach/failure of the treatment cell, normal retention time for treatment could <br />not occur as provided in the permit. However, as soon as the danger presented by the blasting <br />activities was eliminated, the water was rerouted to the West Pit; in the meantime, immediate <br />activities were undertaken to repair the breach. Proper no[ices were submitted in compliance <br />with Part II.A.4. <br />Representatives from Colowyo would be happy to meet with members of the Water Quality <br />Control Division to review and provide clarification to the events, which surround the above- <br />discussed occurrence.
