<br />Mr. Richard Raines Page 2 <br />North Taft Hill Expansion Site M01-051 <br />June 17,2004 <br />A lease of fully consumable water from the Tri-Districts for water to be released from <br />Chambers Lake will be the source of replacement during the months when no credit to the river is <br />available. A lease of 6 acre-feet from the Tri-Districts was obtained to make replacements at the <br />Overland Pond site during the 2004, however since no releases have been made for the Overland <br />Ponds site, Lafarge is proposing to use this lease for the North Taft Hill Expansion site. A copy of <br />the Tri-Districts lease was provided with the proposed plan. The existing lease is valid until October <br />31, 2004. The Tri-Districts lease must be renewed for the year 2005 and a copy must be provided to <br />this office. <br />According to the information provided, beginning February2005, Lafarge West, Inc. will stop <br />dewatering the North Taft Hilt Expansion site. As a result of ceasing the dewatering operation, <br />approximately 13 acres of groundwater will be exposed at the site. Lafarge West, Inc. will continue <br />to make replacement from evaporation from the unlined 13-acre lake until the mining operation will <br />begin again in the future. In addition the proposed plan indicates that Lafarge will replace all post <br />pumping depletions that occurred due to ceasing the dewatering operation, under a new combined <br />substitute water supply plan to be requested by Lafarge West, Inc. that will coverthe North Taft Hill <br />Expansion site, the Home Office Pit site and the Overland Ponds site. The net accretion credits that <br />will be available from the dewatering operation at the Overland Ponds site once the mining operation <br />begins will be applied for the combined plan. <br />The monthly depletions and replacement requirements are found on the attached Table I. <br />I hereby approve the proposed substitute water supply plan in accordance with §37-90- <br />137(11), C.R.S. subject to the following conditions: <br />1. Unless otherwise revoked or modified, this plan shall be valid through January 31, 2005. <br />2. If this plan will not be made absolute by a water court action by the plan's expiration date, a <br />renewal request must be submitted to this office with the statutoryfee (currently $217) no later <br />than December 15, 2004. Ifthe site will be covered undera new combined plan then a request <br />for a new combined plan must be submitted to this office with the statutoryfee foreach site no <br />later than November 1, 2004. <br />3. A well permit must be obtained for the gravel pit in accordance with §37-90-137(2) and (11), <br />C.R.S. in conjunction with this plan. A well permit application was submitted to this office <br />under receipt no. 524322, and this application is pending evaluation. The provisions of <br />Colorado Revised Statute 37-90-137(2) prohibits the issuance of a permit for a well to be <br />located within 600 feet of any existing well, unless the State Engineer finds that <br />circumstances so warrant after a hearing held in accordance with the procedural rules in <br />2CCR402-5. This hearing may be waived if you are able to obtain statements from the <br />owners of all wells within 600 feet, verifying that they have no objection to your use of the <br />proposed well. Should a new well permit be denied for reasons of 600 foot spacing, or any <br />other legitimate reason, approval of this substitute supply plan will be cancelled. <br />4. The total surface area of the groundwater exposed at the North Taft Hill Expansion site after <br />December 31, 1980, under the terms of this substitute water supply plan must not exceed <br />0.5 acres resulting in 0.97 acre-feet of evaporative loss. <br />
