II. Purpose and Objectives <br />The purpose of this Cooperative Agreement is to establish a mechanism and <br />.procedures for (1) the transfer of funds contributed by water project proponents <br />and private donors pursuant to the Recovery Program to the Foundation; and (2) <br />the disbursement of said funds from the Foundation to accomplish Colorado River <br />fishes recovery activities. This Cooperative Agreement will facilitate the <br />accomplishment of recovery activities for the rare Colorado River fishes in an <br />efficient and timely manner. <br />III. Authorities <br />Fish and Wildlife Coordination Act, 16 U.S.L. Sec. 661; <br />Fish and Wildlife Act of 1956, 16 U.S.C. Sec. 742f(a)(4j; and <br />National Fish and Wildlife Foundation Establishment Act, 16 U.S.C. <br />Sec. 3703(c)(6). <br />IV. Term <br />This Agreement shall take effect upon execution, with only subsequent <br />contributed and donated funds being transferred to the Foundation, and will <br />remain in effect until completion or termination of the Recovery Program, <br />whichever occurs first. The term of the Cooperative Agreement that implements <br />the Recovery Program is 15 years. <br />V. Specific Obligations of the Parties <br />To accomplish the purposes and objectives of this Cooperative Agreement, each <br />• party agrees to cooperate with the other to fulfill its obligations as herein <br />provided. <br />A. Service Obligations - The Service will: <br />I. When this Agreement takes effect, inform water project proponents and <br />potential private donors of the procedures for contributing funds to <br />the Foundation, pursuant to the Recovery Program. Procedures for <br />payment of the contributed funds will be specified in the Biological <br />Opinion for each water project which causes a depletion of water from <br />the Upper Colorado River system, and the Service is responsible for <br />ensuring that private and State water project proponents make payment <br />to the Foundation. <br />Identify, from the list of projects included in the Implementation <br />Committee's approved annual work plan, those that should be funded by <br />the Foundation with Colorado River contributed and donated funds. Use <br />of these funds will be coordinated by the Service, on behalf of the <br />Implementation Committee, with the Foundation. (Attachment 1 <br />identifies the current process and schedule for development of the <br />annual work plan by the Implementation Committee.) <br />Develop, in coordination with the Implementation Committee, requests- <br />for-proposals and/or scopes-of-work for work to be funded with <br />Colorado River contributed/donated funds. <br /> <br />
