..... • <br />STIPULATIONS <br />At the time of permit issuance (October 31, 1994), the following exploration boreholes are fully <br />approved for drilling subject to the stipulations below: PEDS-1, PEDS-2, PEDS-3, PEDS-9, and <br />PEDS-10. <br />1) A 1 /4 mile buffer zone shall be maintained between drill sites and the Yampa River <br />and all raptor nests during the winter and spring months. <br />2) Discharge of water from artesian boreholes may proceed only after the Division <br />has received a copy of the Construction Dewatering Permit to be issued by CHOH. <br />If artesian flow is encountered in a borehole prior to the issuance of the <br />Construction Dewatering Permit, then a) the hole must be capped to prevent <br />discharge until the Construction Dewatering Permit is issued, or b) the water must <br />be discharged to a storage tank or vac truck until the Construction Dewatering <br />Permit is issued. <br />3) All conditions stipulated in all leases, agreements, clearances and associated <br />permits issued by the BLM, CDOH, CDOW, USFWS and landowners must be <br />adhered to. <br />The remaining boreholes proposed under the NOI are subject to the above stipulations as well as <br />the stipulations outlined below: <br />4) Site preparation and drilling of any particular borehole may commence only after <br />the Division has received a copy of the cultural resources clearance for that <br />particular site from the BLM. Any conditions set forth in the cultural resources <br />must be complied with. <br />5) Site preparation and drilling of any particular borehole may commence only after <br />the Division has received a copy of the threatened and endangered species <br />clearance for that particular site from CDOW and USFWS. Any conditions set <br />forth in the threatened and endangered species clearances must be complied with. <br />6) Site preparation and drilling of any particular borehole may commence only after <br />the Division has received a copy of the signed BLM lease which permits <br />exploration activiries for that particular hole. Any conditions set forth ir. the BLM <br />lease must be complied with. <br />7) Site preparation and drilling of any particular borehole may commence only after <br />the Division has received a copy of the signed landowner agreement for that <br />particular site.
