Sarvrt - 2.06.5 <br />the pre-disturbance configuration relative to both overall slope stability and drainage. In addition, <br />these areas offer several benefiu relative to the postmining land use including: <br />• Vehicle pullout and turn-around areas along the existing narrow access roads <br />• Slope breaks to limit overland flow, flow velocities, and resultant erosion from upslope azeas <br />• Loading, unloading, and camp areas for livestock perrnittees <br />The final site, the slope above the Sanbom Creek portal face-up area, is now part of the road cut <br />slope for the pemtartent road that will connect the Sanbom Creek road and old State I-pighway 133. <br />Tltis site is and has been stable for some time in its present configuration and areas above the existing <br />highwall slope will not be disturbed. <br />Drainage from all of the subject sites will be maintained or improved by establishing the proposed <br />postminirtg configurations. Suspended solids contributions will be equal to or less than those <br />associated with the premututg configuration and overall watershed characteristics flow patterns, and <br />flow volumes will not be significantly altered. The existing or proposed postmining configuration of <br />these areas and associated reclamation measures are consistent with the intent and regtriremenu of <br />Rule 4.27.4 and there are no plans to remove or replace additional spoil materiak in these areas. <br />The Lower Hubbard and Beaz Creek ventilation facilities sites are on Federal lands, administered by <br />the Bureau of Land Management. The surface disturbances associated with the reclaimed sites are <br />authorized by the BLM under BLM Right-of-Way COG41183. Landowner approvals required under <br />this section are documented by the following letters, copies of which are included in Exhibit 2.03-E 1, <br />Ownership and Right of Entry Documentation: <br />• BLM to Sotnetset Muting Company, dated May 25, 1994 <br />• BLM to DMG, dated February 23, 1996 <br />• Hotchkiss Ranches letter, dated February 20, 1996 <br />Some of the Bear Canyon degassification well sites and the Sanbom Creek portal face-up area are <br />owned by the OMI. OMI has previously requested and obtained approval of a variance to <br />regturemenu for restoration of approximate original contour for all four sites. All of the subject sites <br />have been or will be reclaimed to the proposed postmining land use of undeveloped lands. <br />2.06.6 -Prime Farmlands <br />As previously noted in Section 2.04.12, Prime Farmland Investigauon, no lands fitting the regulatory <br />definition of prime farmlands have been identified in the permit or adjacent areas. The provisions of <br />this sub-section are, therefore, not applicable. <br />2.06.7 - Variance for Delay in Contemporaneous Reclamation Requirements in <br />Combined Surface and Underground Mining Operations <br />As previously described tinder Section 2.06.4, Steep Slope Mining, OMI has not and has no current <br />plans to implement or conduct stri-face mining or reclamation practices in conjunction with ongoing <br />underground mining and related operations. In addition, most of the currently disttrbed surface areas <br />and associated surface facilities will continue to be rued over the life of the underground operations <br />and OMI will not contemporaneously reclaim these areas as mining progresses.
