Cattany <br />Division Director <br />Natural Resource Trustee <br />The Division of Minerals and Geology has completed review of the quarterly reporting submitted <br />for the sediment pond, discharge monitoring reports, and waste pile at the Raton Creek Mine, <br />#C-82-055. Ptease consider our comments and make any necessary changes ar adjustments in <br />future reporting to the Division. <br />Discharge Monitoring Reports (DMR) -The DMR's submitted and reviewed reflects observations <br />consistent with Division monthly inspections. No discharge from the single sediment pond was <br />recorded and/or sampled. <br />Sediment Ponds Inspections- Please ensure that the inspection to comply with Rule 4.05.9{14) <br />and (15) is conducted during a season when the pond is not frozen. Delaying the inspection till <br />the fourth quarter, when it could have been conducted in the second or third quarter is not <br />acceptable. Each inspection report demonstrates compliance with Rule 4.05.9(17) for <br />impoundments. Observations are consistent with field observations noted during Division <br />inspections periodically throughout the year. Also, although a registered P.E. has certified the <br />4~' quarter report, the report lacks the information required by Rule. Depth and elevation of any <br />impounded water and the existing storage capacity for both sediment and water were not <br />documented in the report, due to ice (see comment above). Additionally, the report does not <br />clearly state that the "impoundment has been... maintained as designed, and in accordance with <br />the approved plan and the applicable regulations." Please refer to Rule 4.05.9(14) and (15). <br />This statement should be added to the report for the annual inspection to comply with these two <br />Rule requirements. <br />Waste Pile Inspections -Other than an incorrect date of signature on the 4'" quarter report, the <br />reports meet the requirements under Rule 4.09.1(11) and 4.10.2(2). We have no further <br />questions or comments at this time.
