PART II <br />Page 31 <br />Permit No. COG-600000 <br />• A. NOTIFICATION REQUIREMENTS (otmt.) <br />3. Special Notifications -Definitions <br />a. Bypass: The intentional diversion of waste streams from any portion of a trsauneat facility. <br />b. Severs Property Damage: Substantial physical damage [o property az the t.r~r„~mt facilities <br />which causes them to become inoperable, or substantial and permanent loss of nazural <br />resources which can reasonably be expected to occur in the absence of a bypass. It does not <br />mean economic loss caused by delays in production. <br />o. Spill: An incidelu is which flows or solid materials are accidentally or unintentionally <br />allowed to flow or escaps so m to be lost from the *+*~+~+~, processing or manufacturing <br />system which may cause or threaten pollution of state waters. <br />d. Upset: An exceptional incidem in which there is unintentional and temporary noncompliance <br />with permit effluent limitations because of factors beyond the reasonable control of the <br />pertnittee. An upset does not include aopootupliance to the extent caused by operational <br />error, improperly designed treatment facilities, inadequate treatment facilities, lack of <br />preventative maintenance, or careless or improper operation. <br />4. Noncompliance Notification <br />a. If, for arty reason, the permitrce does not comply with or will be unable [o cot~ly with any <br />dischazge limitations or standards specified is this permit, the permittee shall, az a minimum, <br />provide the Division and EPA with the following information: <br />(1) A description of the discharge and cause of noncompliance; <br />(2) The period of noncompliance, including exact dazes and times and/or the anticipazed <br />time when the discharge will return [o compliance; and <br />(3) Steps being taken to reduce, eliminate, and ptevem recurrence of the noncomplying <br />discharge. <br />b. The petmitta shall report the following ciavmstapces ornlly within twenty-tour f241 hours <br />from the time the permittee becomes aware of the cirtatmstant:es, and shall mail to the <br />Division a written report containing the information requested in Pan Q.A.3 (a) within five <br />fs) day after becoming aware of the following circtttnstanca: <br />(1) Circumstances leading to arty noncompliance which tray endanger health or the <br />environment regardless of the cause of the incident; <br />(2) Circumstances leading to airy unanticipated bypass which exceeds any effluent <br />limitations in the permit; <br />(3) Cim,...~.,^as leading to airy upset or spill which causes an exceedance of nay <br />effluent limitation in the permit; <br />(4) Daily maximum violations for any of the pollutanss limited by PART I.A and I.B of <br />this permit and spxified as requiring 24 hour notification. This includes a~ toxic <br />pollutant or hazardous substance or soy pollutant specifically identified as the method <br />to control any toxic pollutant or hazardous substance. <br />
