CENTRAL APPALACHIA MINING, LLC <br />MONGER CANYON MINE <br />IMPOUNDMENT YEARLY INSPECTION <br />In accordance with Rule 4.05.9(14), all impoundments shall be inspected at least early to <br />determine if the impoundment has been maintained as designed, and in accodance with the <br />approved plan and the applicable regulations. This yearly inspection is for the impoundment <br />located at the Munger Canyon mine refuse disposal area. <br />A July 25, 2005 storm generated peak flows in the Munger Creek watershed that exceeded those <br />associated with the 10 year event. The watershed "F"channel overtopped and filled the refuse pile <br />sediment pond with mud, water and debris. The water and mud flowed into the pond through its <br />open channel emergency spillway. The sedimentwas subsequently removed and the open channel <br />spillway restored to its design configuration. <br />As a result of this problem with the pond, the Operator obtained approval from the DMG, (TR-19), to <br />change the emergency spillway from an open channel to a corrugated metal pipe. On December 22 <br />& 23, 2005, the new emergency spillwaywas installed and the open channel spillwayfilled. A berm <br />has been installed to keep the watershed "F"flow from entering the sediment pond. The Operator <br />installed a 24" diameter corrugated metal pipe instead of the 21" diameter pipe specified in the <br />permit. The 24"diameter pipe is an acceptable substitution since it is larger than the pipe specified <br />in the permit. <br />On December 23, 2005, I performed the required yearly inspection. I, J. E. Sto~.er, have a wide <br />variety of experience in the design and construction of earth fill embankments. Nothing was <br />observed during the inspection that would indicate the pond has a potential for failure. There <br />was no appearance of erosion, instability, structural weakness or other hazardous conditions. <br />There are no required monitoring procedures or instrumentation other than quarterly and yearly <br />inspections. There are no aspects which might affect stability. The pond/impoundment was not <br />discharging during the inspection. <br />There was a pool of ice about 1-fot below the emergency spillway at approximate elevation of <br />5421.
