Date of Possession: Second Party shall have the right of <br />possession of said premises for such mining excavation purposes as more <br />fully set forth herein as of the first day of February, 1983. It is <br />further understood and agreed that Second Party shall have a reasonable I <br />period of time upon the termination date of this contract to retain posses- <br />sion for the purposes of removal of any stockpiled material, stockpiled <br />prior to February 1, 1988. <br />I <br />5. Second Party agrees to hold First Parties harmless from any i <br />and all claims of persons due to damages or injuries sustained to persons <br />or real property due to the mining operations of Second Party. <br />6. Second Party agrees to reclaim all lands mined within one <br />(1) year from the date of termination of this agreement in such manner ` <br />as is in accord with the Mining Land Reclamation Act of the State of i <br />Colorado as is in effect on the date of this contract. <br />7. Second Party shall maintain all fences as legal fences and <br />shall have the right to place gates or means of closing said fences at any <br />point it may so choose. <br />8. It is understood and agreed that this contract is conditioned <br />upon there being in place an adequate supply of gravel suitable for County <br />road use to supply the minimum requirements set forth in this contract. <br />Should an inadequate supply of gravel be found to be the condition, Second <br />Party shall pay for all gravel removed but shall have no continuing obli- <br />gation. <br />9. It is understood and agreed that First Parties shall guarantee <br />right of ingress and egress upon currently constructed roads for use of <br />Second Party's gravel operations. <br />This agreement is retroactive to [he first day of February, 1983. <br />THIS AGREEMENT shall be binding upon the parties hereto, their <br />heirs, executors, representatives, administrators and assigns. <br />IN WITNESS WHEREOF, the parties have hereto set their hands and <br />seals this 2nd day of March, 1983. <br />-2- <br />
