<br />GENERAL <br /> <br />1. The Application does not contain information or copies of <br />applications for 404, highway access, or county zoning and land <br />use permits. Proof of such applications/permits are required by <br />Rule 3.2(1)(k). It also does not contain a written recommendation <br />from the Department of Wildlife. <br />The Application states that a Special Use Permit was obtained <br />from Ouray County on October 15, 1990. <br />This is incorrect. The referenced Permit was granted for an <br />entirely different type of use that promised significant flood <br />control benefits. To our knowledge, an application for the <br />present use has not been submitted to Ouray County. We do not <br />feel that this operation can be consistent with either the Ouray <br />County Land Use Code or Master Plan, although we realize that <br />this is not a concern of the Division. <br />SITE DESCRIPTION <br />1. The Application states the size of the operation to be eight <br />acres. The actual mining area would appear to be in excess <br />of 30$ of the entire 27 acres of owned property. <br />2. The plans do not show the locations where the access roads <br />intersect public roadways. <br />3. The Application does not state that there are no permanent <br />man-made structures within 200 feet of the land to be <br />affected by the operation. It does state that "A sewage <br />lagoon exists approximately 150 feet west of the northern end <br />of the permit area." Again, there is no engineering data or <br />mining plan to ascertain whether this structure might be <br />affected by hydrologic changes. <br />HYDROLOGIC IMPACTS <br />1. The Application does not address the effect on water flow of <br />the Uncompaghre River or offsite impacts from changes in <br />stream flow. <br />2. The Reclamation Plan does not explain how the "bar will have <br />a northerly slope the same as the river gradient and a <br />westerly slope of 1 foot in 500 feet?" This statement is <br />vague (69 total words) and does not allow analysis. <br />3. The mining plan is virtually non-existent and hydrologic <br />impacts cannot be ascertained. <br />Conclusion• <br />The prior application resulted in an inordinate amount of time <br />expended by the Board, the Division, the Ouray County Planning <br />Commission and commissioners, and the public.
