A National Pollutant Discharge Elimination System (NPDES) permit from yet to begin <br />the Colorado Water Qualit Control Board; <br />4. An Air Pollution Emissions Notice (APEN) from the CDPHE; (need to <br />file) Starting <br />5. A letter from the U.S. Fish and Wildlife Service (USFWS) stating that the <br />proposed gravel pit will not directly affect the Preble's Meadow Jumping <br />' pending <br />Mouse <br />s (PMJM) continued existence; <br />6. A letter from USFWS stating that the proposed gravel pit will not directly <br />' Approved <br />affect the continued existence of the Ute Ladies <br />-Tresses Orchid TO ; <br />7. A letter from the U.S. Army Corps of Engineers (USAGE) stating that the <br />proposed gravel pit complies with Section 404 of the Clean Water Act <br />(CWA) because the Department of the Army (DA) does not have the Approved <br />authority to regulate work in isolated wetlands. <br /> <br />H:\SVOh\word\DMG\Exhibit M.doc <br />
