y.. <br />c;Q~3,0~ <br />• <br />all activities on the Leased Premises in a good, prudent and miner-like manner, in <br />accordance with normal, accepted industry standards, and in strict compliance with all <br />applicable governmental laws, regulations, licenses and permits, including without <br />limitation, those relating to the protection of the environment and reclamation of land. <br />Lessee shall be solely responsible for obtaining all necessary governmental <br />licenses, permits, certificates and other approvals for operations to be conducted upon <br />the Leased Premises and pursuant to this Lease. Dumps or stockpiles of waste, <br />overburden, or outer materials produced from outer lands may not be deposited on the <br />Leased J'remiscs. <br />8. Records and Reports. [,essee shall keep books of account of the mining <br />and sale or other disposition of coal from the Leased Premises, such books to be of the <br />usual character kepi by coal operators for such purposes, and which books shall be open <br />at all tinter to rite inspection of the Lessor or its authorized representatives. In addition, <br />Lessee shall provide to Lessor the following: <br />(i) At least semi-annually, a summary report of the <br />status and conduct of operations hereunder, to <br />include a statement of intended operations for <br />the next succeeding quarter. <br />(ii) Copies of drill and core logs, geologic data, <br />reports of sampling and testing of coal and coal <br />deposits, identification of drill hole locations, and <br />outer factual data (exclusive of interpretation) <br />obtained by Lesscc which pertain to the Leased <br />Jremises. <br />9. Assignment. Assignment by Lessee of this Lease shall be su'~+xt to <br />approval by Lessor based upon the financial, technical and operational capabilities of the <br />assignee to perform and comply with the terms hereof, but which approval shat. got be <br />unreasonably withheld. Nolwilltstanding the restriction on assignment as set forU; '~erein, <br />the rights of the Ixssee shall be freely assignable, without consent of Lessor In ti~.urking <br />interest owners, provided, however that such assignments would be effective only upon <br />• receipt of written notice of assignment by Lessor. <br />10.
