Lessor makes no war[antiea of title to the Leased <br />Premises, either expressed or implied. <br />6. Lesser Interest. TC Lessor, as 'T'rustee of the ELIZABETH ANNE EWTNG <br />TRUST dated June 29, 1965, owns less tiraa a one-fourth (1!4) undivided interest in turd <br />to the goal in, upon or underlying the Erased Premises, then the production royalty <br />provided for herein shall be paid to Lessor only in the proportions which its interests bear <br />to the whole, undivided ownership of the coal. <br />7. Conduct of Operations. Lessee shall conduct all operations and maintain <br />all activities on the Leased Premises in a good, prudent and miner-like manner, in <br />accordance with normal, accepted industry standards, and in strict compliance with all <br />applicable governmental laws, regulations, licenses and permits, including without <br />limitation, those relating to the protection of the environment and reclamation of land. <br />Lessee shall be solely responsible for obtaining all necessary govemmrntal <br />licerses, permits, certificates and other approvals for operations to be conducted upon the <br />Leased Premises and pursuant to this Lease. Dumps or stockpiles of waste, overburdrn, <br />or other materials produced from other lands. may not be deposited on the Leased <br />Premises. <br />8. Records and Reports. Lessee shall keep books of account of the mining <br />and sale or other disposition of coal from the Leased Premises, such books to be of the <br />usual character kept by coal operators for such purposes, and which books shall be open <br />at all times to the inspection of the [.essor or its authorized representatives. In addition, <br />Lessee shall provide to Lessor the following: <br />(i) At least semi-annually, a summary report of the <br />status and conduct of operations hereunder, to <br />include a statement of intended operations for <br />the next succeeding quarter. <br />(ii) Copies of drill and core logs, geologic data, <br />reports of sampling and testing of coal and coal <br />deposits, identification of drill hole locations, and <br />other factual data (exclusive of interpretation) <br />nbUincd by Ixssee which pertain to the Lased <br />4 <br />
