<br />COAL MINING LEASE
<br />T111S COAL MINING LEASE (herein the "Lease'), entered into effective
<br />Q C~~ ~"- 3 1990, between W. D. EWING, 1R. of 316 Scenic Avenue, Piedmont,
<br />California 94611, as Trustee for the EXPRESS ELIZABETH ANNE EWING TRUST
<br />created by a Quit Claint Deed from W. D. EWING az grantor to W. D. EWING, ]R. and
<br />W. D. EWING, JR. as Trustee for ELIZABETH ANNE EWING dated Augus! IS, 1967
<br />and recorded at Reception No. 347347 of the records of the La Plata County Clerk and
<br />Recorder on 5eplember 14, 1967 as Lessor, and OAKRIDGE ENERGY, INC., a Utah
<br />corporation, whose legal address is 400 First National Bank Building, Wichita Falls, Texas
<br />76301, as Lessee.
<br />I. Grant. In consideration of the concurrent purchase by the Lessee from the
<br />Lessor of the entire surface estate and certain fractional interests in the mineral estate
<br />in the lands defined hereinafter as the "Leased Premises," and for other good and valuable
<br />consideration, including the production royalties and commitments herein agreed to be
<br />paid and performed by Lessee, Lessor hereby grants and leases to Lessee an undivided
<br />one-fourth (I/4) interest in and to all coal in, upon or underlying the lands described
<br />below located in La Plata County, Colorado, to-wit:
<br />An undivided one-half (1/2) interest in and to Lots 1, 2, 7, R and 9 of
<br />Section 32,'fownship 35 North, Range 9 West, N.M.P.M.,La Plata County,
<br />Colorado, lying and being Easterly of old U.S. Ilighway 550.160
<br />AND
<br />An undivided one-half (I/2) interest in and to all that portion of ll~e
<br />SEl/4SE1/4 of Section 29, Township 35 North, Range 9 West, N.M.P.M.,La
<br />Plata County, Colorado, which lies South of the South Bank of Horse Gulch
<br />(hereinafter the 'Leased Premises'), together with the right to explore for, mine (by open
<br />pit, underground, strip, auger or any other method), transport, remove and marks t all coal
<br />leased herein; and to the extent Lessor has or may have the right and title to Frant and
<br />lease such rights, the right to use as much as the surface of the Leased Premises as may
<br />be recessary or reasonably convenient in the exercise of the rights granted by Ibis Lease,
