PtapertY Rights <br />The i_s^uanoe of this permit does cot convey a~+ pzopr~ty or water <br />rights in either real or per~.,onal property, or stream flows, or any <br />exclusive privileges, nor does it authorize any injury to pr=vote <br />Property or arty invasion oP perso3tal ric~tts, nor any infrit~aoerrt oP <br />Federal, State or local laws or regulations. <br />10. SeverabilitY <br />The provisions of this permit are severable. If any provisions of <br />this permit, or the application of any provision of this permit to <br />any cirLtmstartoe, is held invalid, the application of suds provision <br />to other ciraanstances an3 the application of the remai*+~er of this <br />permit shall not be affected. <br />11. Renewal Application <br />If the permittee desires to continue to disd~arge a pe_*mit renewal <br />application shall be submitte3 at least one hundred eighty (180) days <br />before this permit expires. If the permittee anticipates there will <br />be no di.sdtarge after the expiration date of this permit, the <br />Division should be pr~tly notified so that it can terminate the <br />permit in axordartoe with Part 3=.B.6. <br />12. Confidentiality <br />Any information relating to any secret proce,s, trethocl of manufacture <br />or prt~dttc-tion, or sales ar t~aeting data which has bent declared <br />confidential by the permittee, and rdtidt may be acquired, <br />ascertained, or discovered, whether in any sampling investigation, <br />emergestcy investigatiaat, or offiezwise, shall not be publicly <br />disclosed by any member, ofti,oer, or employee of the ~~~ion or <br />the Division, but shall be 7oe{yt ~f;~te.+r;wt, pny p~,,~ ~tg tp <br />invoke the protecticm of this Subsection (2) shall bear the burden of <br />proving its applicability. This section shall never be interpreted <br />as preventing full disclostrte of effluent data. <br />13. Fees <br />The pesmittee is r+equir+ed to summit payment of an annual fee as set <br />forth in the 1983 w,~,o*~~*+ra to the Water Quality Control Act. <br />Section 25-8-502 (1) (b), and State Disd~uge Permit Regulations 5CCR <br />1002-2, Section 6.16.0 as amended.
