(No <br />determinatiaa~ made d<yrinq arlminietrativg review of claims that <br />rlianoe was caused by upset, and before an action for <br />n~liance, is final adm?*+i~tive action subject to <br />judicial review.) <br />b) Corditions Nece,.saxy far a Danonstration of Upset <br />s <br />A permittee who wishes to establish the affirmative defense of <br />upset shall date through Properly signed contemporaneous <br />ope2ati~ logs, or other relevant evidence that: <br />(i) An upset occurred and that the permittee can identify <br />the specific cause(s) of the upset; arri <br />(ii) 4Yte permitted facility was at the time being properly <br />operated; and <br />(iii) 'Ihe permittee submitted notice o! the upset as required <br />in Part II.A.3. of this permit (24-hair notice); and <br />(iv) ~ie permittee c~lied with any.remedfnl *~a,*~ <br />required under Section 122.7 (d) of the federal <br />zegulations. <br />c) Burden of Ptoof <br />Ia any enlor~t pxxeeding the permittee seeking to <br />establish the ooanxenoe of an upset has the bunien of proof. <br />8.
