Acute WET Testine - Outfalls 001.002. 005, 009, 011, 013. 015, 016. 017 and 019 <br />(ii) The PTI/T[E results indicate that the toxicant (s) represent pollutant(s) that may be controlled with specific <br />numerical limiu, and the Division agrees that the numerical controls aze the most appropriate course of <br />action. <br />(iii) The PTIffIE reveals other unique conditions or characteristics which, in the opinion of the Division, justify <br />the incorporation of unanticipated special conditions in the permit. <br />3. Burden of Proof ReauiremeMs <br />The permittee has the burden of proof when seeking relief from total suspended solids (TSS), total iron and/or settleable <br />solids (SS) limitations. <br />Relief may be granted for each discharge occuttence only when necessary and shall not be granted when the permittee <br />has control over the dischazge. The permittce should endeavor to meet the primary limitations whenever possible. The <br />permittce will need to show that exceedence of the applicable limitations was caused by precipitation and no other source <br />and that the dischazge was beyond their control. All manual dewatering of the ponds shall meet TSS and total iron <br />limitations. Pumping of pit water is not eligible for alternate limitations. <br />a) For rainfall, to waive TSS and total iron limitations, it is necessary to prove that dischazge occurred within 48 hours <br />after measurable precipitation has stopped. In addition, to waive settleable solids limitations, it is necessary to prove <br />that discharge occurred within 48 hours after precipitation greater than the 10-year, 24-hour event has stopped. <br />b) For snowmelt, to waive TSS and total iron limitations, it is necessary to prove that dischazge occurred within 48 <br />hotus after pond inflow has stopped. In addition, to waive settleable solids limitations, it is necessary to prove that <br />dischazge occurred within 48 hours after pond inflow volume greater than the 10-year, 24-hour event has stopped. <br />Should a precipitation event or snowmelt occur, the permittce shall submit adequate proof in order for an exemption to <br />be claimed. Said proof shall be submitted as an attachment to the Dischazge Monitoring Report (DMR) for the <br />appropriate period. The Division shall determine the adequacy of proof. As part of this determination, the Division <br />shall evaluate whether the permittce could Gave controlled the discharge in such a manner that primary limitations could <br />have been met. <br />4. Post-Minine Areas <br />Commencing at the time active mining has ceased and surface areas have bcen returned to the requ'ved contour all <br />applicable dischazges may be eligible for post-mining limitations. These post-mining limitations shall remain in effect <br />until bond release. The permittce shall notify the Division upon cessation of active mining so that consideration of <br />appropriate permit modifications can be made. <br />5. Best Manaeement Practices -001. 002, 005 <br />For the pH variance, as listed in Part I.A.1. to be in effect, the permittce must be taking all reasonable measures ro <br />reduce the pH, including the use of a COr bubbler at the outfalls. Documentation of such shall be submitted with the <br />applicable DMR any time a pH level of over 9.0 s.u. is repoRed. <br />The permittee may develop other appropriate measures to control pH, such as the use of appropriate algicides, aquatic <br />life, etc. However, such measures in addition to or instead of the COr bubbler must be approved by the Division via a <br />permit amendment prior to their use. <br />Amendment No. 1 Issued MAY 3 01997 Effective ,~~~ - 1Qo7 <br />INOY Mawwn ~., nv <br />
