Water Quality Control Di vision <br />Rationale -Page 11, Permit No. CO.0032115 <br />S) Genera! !n(ormarion: The permirree should read the WET testing sections oJParr /.A.2. oJ'rhe permit <br />carefully. The permit outlines the test requirements and the required follow-up actions the oermltree must <br />take ro resolve a toxicity incidem. The permitree should read, along with the documents listed in Parr <br />1.A.2. (a) of the permit, the Colorado Water Oualirv Control Division Biomanitaring Guidance Document, <br />dated July 1, 1993. This document outlines the criteria used by the Division in such areas as granting reli;~` <br />from WET testing, modifying test methods and changing rest species. The permittee siioulcl be aware that <br />some of the conditions outlined above may be subject to change if the facility experiences v change in <br />discharge, as outlined in Part I/.A. / of the permit. Such changes shell be reported « ~ the Division <br />immediately. <br />6) Outfalls 003. 006. 008, 010. 012 and 014: these outjalls consist surface runoff Bey cruse these six outjalls <br />consist ojsurface runoff only and discharge during periods of hfgh stream Jlow, they are not believed to <br />contribute toxicity. On this basis, WET resting is not a requirement for these ourJalls. However, the <br />Division reserves the right ro reopen the permit to include WET resting, should facility conditions change w <br />ijnew information becomes available. <br />4. Stormwater Evaluation: Stormwater from active and inactive coal mining sires that has been contaminated by <br />contact with overburden, raw material, intermediate products, byproducts, finished products or ~susre products <br />located at the site is required ro be covered by a Colorado Discharge Permit System (COPS) permit in order to 6e <br />discharged to Waters of the State. This coverage may be obtained under either a COPS lndustrinl Wastewater <br />Discharge Permit or a COPS Stormwater Discharge Permit. <br />The Division understands that all discharges of stormwater pass through outjalls covered urufer permit CO-0032115. <br />Any discharges that consist only of stormwater that have become contaminated as described above, that do nor <br />discharge through the outjalls for permit number CO-0032115 must be covered by a Stormwater Discharge Permit. <br />Starmwater permitting issues for this facility will be handled separately by the Division's Srormwater Unir, although <br />this permit may be reopened at a later date to incorporate srormwater provisions. if deemed appropriate. <br />S. Economic Reasonableness Evaluation: Section 25-8-503(8) of the revised (lone 1985) Colorado Water Ouality <br />Control Act required the Division ro 'determine whether or not any or al! of the water quality standard based <br />eJjiuent limitations are reasonably related to the economic, environmental, public health and energy impacts to the <br />public and affected persons, and are in furtherance of the policies set jonh in sections 25-8-/92 and 25-8-104.' <br />The Regulations for the Stare Discharge Permit System, 6.I.0, further define this requirement under 6.12.0 and <br />state.• "Where economic, environmental, public health and energy impacts to the public and affected persons have <br />been considered in the classifications and standards setting process, permits written to meet the standards may be <br />presumed to have taken into consideration economic factors unless: <br />a) Anew permit is issued where the discharge was not in existence at the time of the classification and standards <br />rulemaking, or <br />bl !n the case of a contiwing dischargt, additional information or factors have emerged that were not anticipated <br />or considered at the time ojrhe classification and standards rulemaking.' <br />The evaluation for this permit shows that the Water Quality Control Commission, during their proceedings to adap~ <br />the Classification and Numeric Standards for the Arkansas River Basin, considered economic reasonableness. <br />Furthermore, this is rsot a new discharger and no new information has been presented regarding the classifications <br />and standards. therefore, the water quality standard-based efJiuent limitations of this permit are determined to be <br />reasonably related to the economic, environmental, public health and energy impacts ro the public and affected <br />persons and are in furtherance of the policies set forth in Sections 25-8-102 and 104. /j use permirree disagrees w:.' <br />this finding, pursuant to 6./2.0(2)(6) the permittee should submit all pertinent information to the Division during the <br />public notice period. <br />B. Monitoring <br />1. E(iluent Monitoring: Effluent monitoring will be required as shown in Tables VI-6 through VI-8, Refer to the <br />permit for locations ojmonitoring points. Sample type for pH has changed from "Grab" to "Irs-Situ" to reflect rhr <br />need !o analyze soon after sample collection, er dictated by the approved methodology. .9na1)¢ing several hours ,-- <br />days after sample collection often yields unreliable results. <br />
