<br />(d) Construction is complete and the Permittee has <br />submitted information to the Director by certified <br />mail with return receipt requested, including <br />schematic (wellbore diagram after construction) <br />and the drilling, construction and cementing <br />records, a notice of completion of construction <br />using EPA Form 7520-10; and either: <br />(i) The director has inspected or otherwise <br />reviewed the new injection well and finds it <br />is in compliance with the conditions of the <br />Permit; or, <br />(ii) The Permittee has not received, within <br />thirteen (13) days of the date of the <br />Director's receipt of the report required <br />above, notice from the Director of his or her <br />intent to inspect or otherwise review the new <br />solution mining well(s), in which case prior <br />inspection or review is waived and the <br />Permittee may commence injection. <br />2. Mechanical Integrity. The Permittee must establish and <br />shall maintain mechanical intecrity of all wells <br />covered under this Area Permit in accordance with <br />90 CFR § 146.8. The mechanical integrity demonstration <br />consists of two parts: <br />(a) Part I demonstrates no significant leaks in the <br />casing, or tubing, by using the standard annulus <br />pressure test or another approved method; 40 CFR § <br />146.8(a)(1) and, <br />(b) Part II demonstrates no significant fluid movement <br />into an underground source of drinking water <br />(USDW) through vertical channels adjacent to the <br />wellbore by running a temperature log, noise log <br />or oxygen activation log within six (6} months <br />following receipt of the Assistant Regional <br />Administrator's letter authorizing American Soda <br />to commence injection. Also the well must have <br />been in operation for 30 days. However, should <br />the nature of the casing preclude the successful <br />use of a temperature log survey, a noise log or a <br />Oxygen Activation log, then pursuant to 40 CFR § <br />146.8(c)(3), cementing records along with a cement <br />bond log or cement evaluation log may be used to <br />EPA FINAL Area Permit No. CO3858-00000 <br />Page 16 of 164 <br />
