MAR-13-2000 16 13 • DIV 5 WTR RESOURCES • 1 303 866 5415 P.05i06 <br />l' <br />~a <br />DISTRICT COURT, WATER DIVISION N0. 5, COLORADO ~ ~:~'~ `'~ <br />,- ~, <br />Application No. 87CW279 <br />RULING OF REFEREE <br />IN THE MATTER OF THE APPLICATION FOR WATER RIGHTS OF YVONNE D. ~CHAMBERS';`IN <br />THE COLORADO RIVER, IN GARFIELD COUNTY <br />The above entitled Application was filed on December 17, 1987, and was <br />referred to the undersigned as Water Referee for Water Division No. 5, State <br />of Colorado, by the Hater Judge of said Court on the Ilth day of January, <br />1988, in accordance with Article 92 of Chapter 37, Colorado Revised Statutes <br />1973, known as The Water Right Determination and Administration Act of 1969. <br />And the undersigned Referee having made such investigations as are <br />necessary to determine whether or not the statements in the Application are <br />true and having become fully advised with respect to the subject matter of the <br />Application does hereby make the following determination and Ruling as the <br />Referee in this matter, to wit: <br />1. The statements in the Application are true. <br />2. The names of the structures involved are Chambers Ponds Nos. 1. 2, <br />3, and 4. <br />3. The name and address of the Claimant: Yvonne D. Chambers; P. 0. Box <br />768; Silt, Colorado 81652. <br />4. The source of the water for all three ponds is the Colorado River <br />and return flow from Applicants' irrigation water. <br />5. The points of storage are as follows: <br />A. Center of Yvonne Chambers t'ond No. 1 is located in Section <br />11, T. 6 5., R. 93 W. 6th P.M. at a point 1258 feet S. of N. Line and 1900 <br />feet W. of E. line of said Sec. 11. <br />B. Center of Yvonne Chambers Pond No. 2 is located in Sec. 14, <br />T. 6 S., R. 93 W. 6th P.M. at a point 550 feet E. of W. line and 200 feet S. <br />of N. line of said Sec. 14. <br />C. Centar of Yvonne Chambers Pond No. 3 is located at the South <br />Quarter Corner of Sec. 11, 7. 6 S., R. 93 W. 6th P.M. <br />D. Center of Yvonne Chambers Pond No. 4 is located 860 feet E. <br />of SW Corner of Sec. 11. T. 6 S., R. 93 W. 6th P. M. <br />b. The use of the water is fish culture and the watering of 50 head of <br />livestock. Pond evaporation losses will be replaced by releases from Green <br />Mountain Reservoir pursuant to Senate Document 80. <br />7. The date of initiation of appropriation for all four ponds is 1975. <br />5 <br />
