CP-F <br />•, ~ -~- ~ • <br />Permit No. Ik77_7LA <br />as indicated in Exhibits (s) A&C of the permit file, subject to ttie following <br />special conditions: <br />1. During the course of mining operations, Ideal Basic Industries <br />shall not allow the total disturbed acreage to exceed the following <br />limitations: <br />Major Disturbance 100 acres <br />Moderate Disturbance rn acres <br />Minor Disturbance ~_acres <br />For purposes of this condition, major disturbance, moderate disturbance, <br />and minor disturbance are defined as follows: <br />Mayor Disturbance - that area of a mining operation which includes <br />excavations, overburden spoils, and topsoil stockpiles. <br />Moderate Disturbance - that area of a mining operation which ie a result <br />of backfilling of the open cut, the levelling of overburden spoils, the <br />smooth grading and the distribution of topsoil or other suitable, approved <br />plan[ growth medium. <br />Minor Disturbance - that area of a mining operation which is undergoing <br />preparation immediately prior to planting, or seeding, is being planted <br />or seeded, or has been planted or seeded but will not be release•i from <br />bond until there has been full completion of .all reclamation requirements <br />as set forth in the permit. <br />2. Ideal Basic Industries agrees to be bound by all Rules and Regulations <br />of the Mined Land Reclamation Board, and by all nrovisiona of die 1976 Mined <br />Land Reclamation Act, in compliance with each and every provision thereof, <br />as an express provision of this permit. <br />3. Any lands included in this permit which may have been preyiously mined <br />without a permit are included solely for the purpose of obtaining a reclamation <br />plan and bonding coverage for such lands. Such inclusion shall not validify <br />any mining previously conducted without a permit which may be punishable <br />under CRS 1973, 34-32-113(2)& CRS 1973, 34-32-123 b 124, as amended. <br />This permit is issued subject to all requirements of the Colorado MLned Land <br />Reclamation Act and all rules, regulations and standards now in force and any <br />which may in the future be promulgated by the Mined Land Reclamation Board, and <br />Chis permit may be revoked or suspended for noncompliance with the .Act and/or <br />such rules, regulations and standards. <br />Dated at Denver this 10 MI <br />day of October 1978. <br />By <br />
