(Bell, Bureau of Land Management, Emerson, Lewis, Messinger, <br />~~ Moms, Olin, Trost, and Ute Mountain Tribe) One notification (Lewis) w•as <br />returned as un-claimed after three notifications to the addressee at the co~rmed <br />"correct' address, as required by U. S. Postal Service. Proof of notice for <br />`- Emerson, as you have already noted, was famished earlier. <br />~ ~V~/ 2) PER4i~u\`ENT MA:~I-~1ADE STRUCTURES <br />\, ~ Exhibit S, Page 4~ of the permit application lists all fences and gates and the <br />j ~ existing access trails. The third paragraph of that eti}tibit demonstrates that the <br />` ~ setback distance of mining activity from fences and gates is sufficient for <br />•-~ protection of fences and gates from structural damage from mining activity. <br />The fourth paragraph of Exhibit S is hereby corrected to read, "Unimproved <br />access trails across the site must be left intact during permitted operations to <br />provide access to customary users and for access for mining operations. Both the <br />"north" and "south" routes are more than 15 feet distant from mining excavation <br />activity and are in no danger of structural compromise from stable bacLslopes <br />excavated no steeper than 3-horizontal to I-ver[ical in dry• soils composed of <br />silty sandy gravel Normal maintenance of both routes is assured by agreemerus <br />negotia[ed between the applicant and the permittee/operator and are provided as <br />a parr ojthe permil application, *Exhibit S.
