Chiappone State of Colorado Division Division of Minerals and Geology Department of Natural Resources 1313 Sherman Street, Room 215 Denver, CO 80203 Dear Barbara: RECEIVED MAR 2 g 2000 Division of Minerals & GeOPogy Thank you for contacting me regarding the 110 Construction Materials Reclamation Permit Application package for the State Line Ranch pit, which I submitted to the Division on March ] 0, 2000. The purpose of this letter is to address each item that you indicated must be received in order to continue with the permit application review process: Completing Item No. 3, Pernutted Acreage, on the application form: Done (see resubmitted form). This was an omission on my part and I apologize for the oversight. Exhibit D -Reclamation Plan: I did not submit a cost estimate for the Reclamation Plan because the Medicine Bow-Rout[ National Forest will perform reclamation work using our own resources and equipment. I discussed this item with our Forest Engineer, Marv Froistad, and Marv felt that since we ate a Federal Government entity, and we are signing a Performance Warranty, that should be adequate to ensure the reclamation work will be completed as indicated in the warranty and plans. However, I have included a cost estimate with this letter which indicates estimated costs for a private contractor to reclaim the pit in accordance with the Reclamation Plan, in the very unlikely event that the Medicine Bow-Rout[ National Forest would default on their reclamation responsibility. Exhibit J -Proof of Mailing Notices of Permit Application: I have always associated the North Park Soil Conservation District with the District Conservationist, AI White. I did not realize that there was another Soil District entity in North Park and I apologize for this oversight. I have sent a Notice to the Board of Supervisors as required (see attached Receipt of Mailing). Exhibit L -Permanent Man-Made Structures: I have resubmitted Exhibit L to include the State Highway 125 right-of-way fence. As noted in this exhibit and in the Mining Plan, all development will occur away from the area of the fence and there is currently a I50' buffer between the existing development and the fence that will remain undisturbed.
