Alt SWMPs required under this pemut are considered reports that shall be available to the public under Section 308(6) of the
CWA. The owner or operator of a facility with stonnwater discharges covered by this permit shall make plans available to
members of the public upon reguestx unless the SWMP has been submitted to the Division. However, the pennittee may claim
any portion of a WMP as connTt__idenhal in accordance with 40 CFR part 2.
g. Annual Report
The pennittee will be required to submit an Ammual Report, covering January 1 through December 31 of each year, on the
overall compliance with the SWMP. The Annual Report shall contain, at a mttumum:
i) Name of pemaittee, address, phone nurrtber, and permit certification number.
it) A report on the facility's overall compliance with the SWMP, including a progress report on all remediation activities,
iil) A summary of each comprehensive stormwater facility inspection made, including date, findings, and action taken.
rv Results and interpretation of any stormwater monitonn perfotmed.
v) Certification language and signature by the permittee. ~ ee Part LD.E.2 of the permit.)

h. Termination of Stormwater Pemrit Coveraee Requirement
i) Termination Criteria
a) Reclamation Permit Release: When a site has been reclaimed in accordance with the Colorado Division of Minerals
and Geology (CDMG) requirements and the site has been released from State reclamation requirements, the permittee
may request termination of the storrrrwater coverage under this perntit.
ri) Request for Temunation
When a site has been reclaimed in accordance with the CDMG requirements and the site has been released from State
reclamation requirements, the permittee may request termination of stormwater coverage under this permit. The Division
will consider termination of stonnwater coverage when:
a) the pemnttee has submitted a completed Inactivation Form as provided by the Division which summarizes the work
accomplished;
b All stonnwater discharges to state waters associated with mining activities have ceased and the CDMG performance
bond has been released;
d) The Division fords that the pemvttee has shown reasonable grounds consistent with the Federal and State statutes and
regulations for such termination; and
e) Fee requirements of Section 61.15 of the State Dischazge Permit System Regulations have been met.
Continued coverage may be required after reclamation or remediation has been completed if the Division has shown or has
reason to suspect that ttre stormwater drschazge may contribute to a violation of a water quality standard.
i. Stormwater Definitions
a, Best management practices (BMPs): schedules of activities, prohibitions of practices, maintenance procedures, and other
management practices to prevent or reduce the pollution of waters of the State. BMPs also include treatment, operating
procedures, and practices to control site runoff, spillage or leaks, waste disposal, or drainage from material storage. BMPs
include stnrctural and nonstructural controls.
b. Operator: the individual who has day-to-day supervision and control of activities occurring at the mine site.
c. Remediation, as used in this pemtit, means actions taken to reduce or eliminate the overall adverse environmental impact
associated with a pollutant source. The term includes actions such as repouting of surface flows, re-location or a pollutant
source, the addition of pollutant neutralizing or immobilizing substances, capping and re-vegetation.
d. Significant Materials include but aze not limited to: raw materials; fuels; materials such as metallic products; hazardous
substances designated under section 101(14) of CERCLA; fertilizers; pesticides; and waste products such as ashes, slag and
sludge that have the potential to be released with stormwater dischazge.
E. GENERAL MONITORING, SAMPLING, AND REPORTING REQUIREMENTS
1. Routine Renortine of Data
Reporting of the data gathered in compliance with Part LB.1 shall be on a monthly basis. Reporting of all data gathered shall comply
with the requirements of Part LE. (General Requirements). Monitoring results shall be s~~mmar+~ed for each month and reported on
Division approved dischazge moni{oring report (DMRI fomvs (EPA form 3320-1). The forms shall be mailed to the agencies listed
below so they aze received no later than the 28th day of the following month. If no discharge occurs during the reporting period, "No
Dischazge" shall be reported.
