PARTI
Page No. 11
Permit No.: CO-0038776
2. StormwaterReouirements
a. Stonnwater Manaeement Plan
A current Sionnwater Management Plan (SWMI') shall be maintained for the portions of the West Elk Mine that are covered by
this section of the permit. The SWMP shall be prepared in accordance with good engineering ractices. (The plan need not be
completed by a registered engineer.) The plan shall identify potential sources of pollution including sediment) which may
reasonably be expected to affect the quality of stormwater discharges associated with the inactive mining opperation. In addition,
the plan shall describe and ensure the implementation of best management practices (BMPs) which will be used to reduce the
pollutants in stotmwater discharges associated with the inactive mining operation and to assure compliance with the terms and
conditions of [his permit.
Mountain Coal Co. must implement the provisions of their SWMP as a condition of this peimit. The Division reserves the right
to review the plan, and to require additional measures to prevent and control pollution as needed.
SWMPs which met criteria contained in the previous version of this perinit are acceptable.
Active Minine Areas
The S WMP shall include the following items for active portions of the mine, at a minimum:
i) Description of Minine Activities
The plan shall provide a nanative description of the mining and associated activities taking place at the site which affect or
may affect storrrtwater runoff intended to be covered by thts permit. The narrative descnpnon shall report the total acresge
within the mine site and an estimate of the number of acres of disturbed area. A general description of the location of the
mining site relative to major transportation routes and communities shall also be provided.
ii) Area Subiect to Effluent Limitations Guidelines
Each plan shall describe the portion of the Honing site which contributes runoff to azeas subject to effluent limitations
guidelines contained in 40 CFR subchapter N.
iii) Site Map
Each plan shall provide a site map or maps which indicate at a minimum:
- mining/stilling site boundaries and access and haul roads;
- equipment storage, fueling and maintenance azeas;
- rnatenals handling azeas;
- azeas used for storage of overburden, materials, soils or wastes;
- azeas used for outdoor manufacturing, storage or disposal of materials;
- location of mine drainage or any other process water;
- tailings piles/ponds, both new and pre-exrstingg;
- mine drainage or any other process water dischazge points;
- springs, streams, wetlands and other surface waters; and
- boundary of azea that contributes runoff to outfalls that are subject to effluent limitations guidelines.
For those areas ou`side of the area that contributes runoff to outfalls that are subject to effluent limitations guidelines:
- an estimate of the direction(s) of surface flow;
- stonnwater ouffalls and an outline of the drainage area of each stormwater ouffall;
- each existing stmctural control measure to reduce pollutants in stormwater runoff; and
- the locafion of impervious stmctures (e.g. pazking lots, roofs, etc.)
iv) Stormwater Manaeement Controls
Mountain Coal Co. shall develop a description of stortnwater quality controls appropriate for that site, and implement such
controls. The appropriateness and prionttes of controls in the plan shall reflect identified potential sources of pollutants at
the mining site. The description of stormwater quality connols shall address the following minimum components, including
a schedule for implementing such controls:
a) SWMP Administrator -The SWMP shall identifv a specific individual or individuals within the mining organization
who is responsible for developing the SWMP and assisting the mine operator in its implementation, maintenance, and
revision. The activities and responsibilities of the administrator shall address all aspects of the facility's SWMP.
b) Identification of Potential Pollutant Sources and Best Mansgement Practices -The SWMP shall identify potential
sources of pollutants at the site, and assess the ppotential of these sources to contribute pollutants to stormwater
dischar es associated with minin activities. The SWMP must also describe appropriate Best Management Practices
(BMPsgto seduce the ppotential of these sources. to connibute pollutants to stomawater dischazges. At a minirtium, each
of the following shall be evaluated for the reasonable potential for contributing pollutants to ntnoff:
- loading and unloading operations;
- outdoor storage of chesncals or equipment;
- outdoor mining-or processing activities;
- historic mine drainage;
- tailings ponds;
- crashing facthties or significant dust and particulate generating activities; practices; and
-stockpiles of overburden, raw material, intermediate products, byproducts, finished products or waste products.
Revised 4/I92004
