Permit No. CO-0038776 <br />County: Mesa <br />AUTHORIZATION TO DISCHARGE UNDER THE <br />COLORADO DISCHARGE PERMIT SYSTEM <br />In compliance with the provisions of the Colorado Water Quality Control Act, (25-8-101 et seq., CRS, 1973 as amended) and the Federal <br />Water Pollution Control Act, as amended (33 U.S.C. 1251 et seq.; the "Act') the <br />MOUNTAIN COAL COMPANY, LLC <br />is authorized to dischazge from the West Elk Mine located in the NE'/., Section 16~ T13S, R90W; 38 degrees 55' 30" north latitude, 107 <br />de ees 2T 00" west lon itude; approximately one mile east of Somerset, CO, on lirghway 133 to the North Fork of the Gunnison River, <br />Sy~ester Gulch, West Sgylvester Gulch the Dry Fork of Minnesota Creek and Lone Pine Gulch m accordance with effluent limitations, <br />monitonng requirements and other conriitions set forth m Part I and II hereof All discharges authorized herein shall be consistent with the <br />terms and conditions of this permit. - ~~- <br />The applicant may demand an ad.l'udicatory hearing within thirty (30) days of the issuance of the fmal permit determination, per the Colorado <br />Dischazge Perznit System Regulations, 61.7(1). Should the applicant choose to contest an of the effluent limitations, morntorin& <br />requirements or other conditions contained herein, the applicant must comply with Section 24-4-104 CRS and the Colorado Discharge Perrmt <br />System Regulations.
