<br />S SUMMARY <br />This report contains the documented approval and conditions for approval for <br />mining within 500 feet of an abandoned underground mine. These approvals <br />are required by the Surface Mining Control and Reclamation Act of 1977, <br />Public Law 95=87, Section 515(b)(12)(A) and the regulations of the Colorado <br />Mined Land Reclamation Board for Coal Mining (1980), Section 4.19. <br />CONCLUSION <br />The abandoned Delagua underground mines are located in a remote area. The <br />proposed surface mining is located in the same 6 foot coal seam as the <br />abandoned underground mines. The underground workings are quite extensive, <br />and the mapping may not be accurate. It is anticipated that the Trinidad <br />Basin Strip Mine (Delagua Strip Mine) may intersect old mine workings, and <br />the mine operator will be required to establish appropriate precautionary <br />procedures to insure the safety of the miners. <br />Under no circumstances shall workers be permitted in the abandoned workings <br />while mining is in process. <br />Subject to the submitted plan (attached) and the above conditions, blasting <br />approval is hereby granted for the Trinidad Basin Mining Company, Incorporated, <br />I.D.
