Long <br />Division D~redo~ <br />Listed below are adequacy review comments for the S & H Mine New 1 12 Pennit Application, File No. <br />M-2000-158. The Division of Minerals and Geology ("Division") is required to make an approval or <br />denial decision no later than March 27, 2001, therefore, your response to the following adequacy review <br />concerns should be submitted to the Division as soon as possible. <br />1. As required by Rule 1.6.5 (2), please submit the proof of publication of the public notice circulated <br />in the local newspaper and all owners of record of surface lands, and easement holders that are on <br />the affected land and within 200 feet of the boundary of the affected land. Proof of notice may be <br />return receipts of a Certified Mailing or by proof of personal service. <br />Rule 6.4 3 Exhibit C- Pre-Mining and Mining Plan Maa(sl of Affected Lands <br />/2. Exhibit C-1 is defined as the Mining Plan Map. The map legend indicates that mining and <br />reclamation will affect the entire permit area. This includes portions of the South Platte River, oil <br />wells and associated gas lines. Please revise the map to show the limits of excavation, and the areas <br />that will be avoided taking into account off set distances from the South Platte River, irrigation <br />ditches and permanent man made structures. <br />Rule 6.4.4 Exhibit D-Mine Plan <br />~~. On Page 4, the applicant states that any change in the final configuration of a lake will be addressed <br />in the annual reclamation report. Please be aware that changes in the reclamation plan will need to <br />be addressed as an amendment or revision to the permit, and not just submitted in the Annual <br />Reclamation Report. Please refer to Rules 1.1(6) and 1.1(49) for what may constitute an amendment <br />or a revision to the permit. <br />1/4. On page 5 of the application, it is stated that 831.1 1 acres of the 1139.4 acres will be mined. [f you <br />add up the disturbed area (768.32 lake area + 64.17 reclaimed area + 12.75 roads) the total affected <br />
