This letter is in response to the Memo to you from Allen <br />Sorenson dated May 29, 2001 concerning mining setbacks. At page two of the <br />memo, Allen Sorenson indicates that a complicating factor with the establishment <br />of the mining setback of the powerline easement boundary specific to the site is <br />that there is some confusion as to the width of the easement. The memo goes on to <br />state that "the permit application states that the property deed references a 40 foot <br />wide easement, but the electric utility claims that the easement is 100 feet wide. <br />No documentary evidence for either of the claims is provided in the permit <br />application; as a result, for permitting purposes, the division must assume a 100 <br />foot wide easement unless it can be demonstrated to the satisfaction of the <br />Division, in consultation with the Attorney General's Office, that 40 feet is the <br />correct easement width." <br />The intent of this letter is to eliminate the confusion as to the width of the <br />easement. I have enclosed a copy of the only documentary evidence concerning <br />the width of the easement, the Transmission Line Right of Way Easement dated <br />1966 and recorded March 7, 1996 in Book 718 at Page 320 of the Routt County <br />public records. This document grants aright-of-way from Camilletti & Sons, Inc. <br />to Yampa Valley Electric Association for the installation of a transmission line and <br />the right "to cut and trim trees and shrubbery located within 20 feet of the center <br />line of said line." This clearly grants Y.V.E.A. a 40 foot wide easement. Nowhere <br />in the document is there any reference to a 100 foot wide easement. <br />If I can answer any further questions concerning this matter please do not hesitate <br />to call me. <br />
