Excluding the well permit filing fee required by <br />section 37-90-116 (2), al] fees collected with ~,a replacement <br />plan shall be credited to the gravel pit lakes augmentation <br />fund, which fund :is created in section 37-90-137..(11) (f). <br />(f) A person who has obtained a reclamation permit <br />pursuant to .section 34-32-112, C.R.S., shall. be allowed to <br />apply for a single well• permit and to submit a single <br />replacement .plan 'for the entire acreage covered by the <br />reclamation plan without regard to the number of gravel pit <br />lakes located within such acreage. <br />SECTION 4. 37-80-120, .Colorado Revised Statutes,. is <br />amended BY THE ADDITION OF A NEW SUBSECTION to read: <br />37-80=120: Upstream storage •- <br />nistoric natural aepietion.~..t~~ in aetermining the quantity <br />of water .required as 'a ,substitute supply ~~to ~ replace <br />evaporation=:from::.ground. water :exposed to the atmosphere .in <br />connection with the extraction of sand and gravel by open <br />mining as defined in section 34-32-103 (9); C.R.S., there <br />shall•be no requirement to replace the amount of historic <br />natural depletion to the waters of the state,•if any, caused <br />by the preexisting natural vegetative cover on the surface of <br />the area which will be, or which .has' been,:permanently <br />replaced by an open water surface. The applicant -shall bear <br />the burden of proving the historic natural depletion. - <br />SECTION 5: ~~'-37-92-305,- Colorado Revised' Statutes, as <br />amended, is amended BY THE ADOITION OF A HEW SUBSECTION to <br />read: ~ - <br />37-92-305.
