<br />and continually thereafter complied with a written agreement <br />with a water conservancy district or water users' association <br />to replacer or augment, the depletions .in connection wi.th'or <br />resulting from open mining of sand .and gravel. ~ - <br />(II)° Any~person~who extracted sand and gravel by open <br />mining •. and exposed -ground water to the atmosphere after <br />.December 31,"'1980, shall apply for a:well permit, pursuant to <br />this section and, if applicable „ shall apply for approval of a <br />plan for augmentation or a pion of substitute supply prior to <br />July 15, 1990. -- _._ __ ._ ___._. <br />(b) If any ground water was exposed to the'~atmosphere''in <br />connection with the extraction of sand and gravel by open <br />mining as defined in section 34-32-103 (9), C.R.S., prior to <br />January 1, 1981, no su:h well permit, plan f.or,.,augmentation, <br />or plan .of substltute_.supply shalt be required to replace <br />depletions from evaporation; except that the burden'of p"roving <br />that such ground water was exposed prior to January 1;' 1981, <br />shall be upon the party claiming the benefit of this <br />.exception.-.Notwithstanding .the :provisions of, _; this -paragraph <br />(b),',judgments"'.'andp,decrees'- entered.-prioT;,'to-July,1,:1989, <br />approving plans"for :,augmentation, which plans include the <br />replacement "-of' depletions from such' evaporation, shall be <br />given full effect and shall be enforced according'°to "their <br />terms. <br />- V,(c).
