On st 26 - 27 1981 the Mined Land Reclamation' <br />Board ("[he board" approved operator'; aoolication for this <br />permit, fixed the amount of bond and directed that this permit <br />be issued upon the filing with the Mined Land Reclamation Division. <br />("the division") of bond in the amount so fixed in form and substance <br />approved by the division, and such bond has been so furnished. <br />C. On A gygt 26 - 27 198-, the board made the following <br />findings: ' <br />[he application for this permit complies with the <br />requirements of the Colorado Mined Land Reclamation <br />Oct, C.R.S. 1973, 34-32-101 et seq. as amended ("the <br />Act") and with all applicable local, state and federal <br />laws; <br />2. the operation will no[ adversely affect the stability <br />or' any significant, valuable, and permanent man-,Wade <br />structure located within two hundred feet of the affected <br />land, zxcept where there is an agreement between oper- <br />ator and [he persons having an interest in t'ne struc- <br />ture [hat damage to the structure is [o be compensated <br />for by operator; and <br />3. the proposed mining and reclamation opera[io,ns can be <br />carried out in conformance with the requirements of <br />the Act. <br />D. Operatcr has made a showing satisfactory to the board: <br />(1) rhat it will employ, during and after its ~~nderground <br />mining and surface operations. Procedures reasonably designed <br />to minimize, as much as practicable, environmental disturb- <br />ance from such opera *. ion; ~2) [hat _ will provide for <br />reclamation of the affected lands appropriate to t„e subse- <br />quent beneficial use of such land;; and (3) [hat, in the <br />event o* [he failure of its proposed reclamation plan, it <br />~.ii I I take ~•~hatever measures may Se necessary [o assure t'ne <br />success of reclamation or` the lands affected by such opera- <br />tions in accordance pith C.R.S. 1973, 3li-32-101 et seq. <br />Rev. 7/7/$1 <br />
