The leasehold rights hereby granted To Lessee and <br />ilre terms aril conditions governing The exercise and enjoyment of such rights include, but <br />not in limitation, all of the following sole and exclusive rights as may be required, neces- <br />sary or convenient for any and all purposes incidental fo a ossoci ated with prepnratiar, <br />- removal and mining of coal by underground methods: (a) to construct, erect, maintain, <br />repair, operate, use, replace, renew, and remove telephone and electric power lines, <br />electric substations, and other associated equipment which shall be located, whenever <br />practical to do so, along or near the boundary lines of said Premises; (b) to lay and con- <br />struct a pipeline extending from the workings of the mine to a place or places on the <br />surface so that the drainage may be discharged into some water course or some natural <br />drain on the surface, a at the option of Lessee into a pipeline or pipelines over and <br />• across the surface of the Premises, to be laid below the plow line if the same is laid in a <br />cultivated field; (c) to mine and remove all such coal that can be economically mined and <br />removed together with such other minerals and materials as if may be necessary to mine <br />and remove said coal a any part thereof; (d) fo transport, without any charge therefor, <br />to a from adjoining or other premises in which Lessee has rights to mine coal through or <br />across the above-described Premises by means of underground ways or underground <br />haulage routes all said coal, together with all machinery, equipment, tools and supplies, <br />and also the right To dr oin and ventilate, through openings or drains in, under or upon said <br />described Premises, all mines in a upon such other lords in which Lessee has right To <br />mine coal. In the event any of the above operations cause damage to the surface or any <br />improvements on the surface, the Lessee agrees to pay damages fo the surface or any <br />improvements on the surface and if necessary to fence any surface installation. How- <br />ever, Lessee has the right To mine and remove said coal or any part thereof by under- <br />grormd mining methods, oil said coal without being liable for any injury or damage to The <br />surface overlying said coal a anything thereon a therein from any and all causes whaf- <br />scever or for surface subsidence cowed by mining the cool or from not leaving pillars or <br />• artificial supports under said land, EXCEPT that Lessee shall be liable to the owner of <br />such surface for any subsidence damage to the surface owner's improvements located <br />thereon, including buildings, wells, ponds, dams, fences, and roads.
