a <br /> <br />TECHNICAL REVISION N0.34 <br />2C~f~to <br />MODIFICATION OF RECLAMATION CONTOUR ACROSS <br />LONG TERM SPOIL AREA <br />In submitting this Technical Revision No. 34, Coors Energy Company (CEC) seeks to <br />modify the final contour over the area known as the Long Term Spoil Area (LTSA). This <br />area, identified in Appendix Q-1 of the Keenesburg Mine Permit, Permit Number C- <br />1981-028 (the "Permit"), has been the source of material for both the intermediate and <br />final cover of ash in the ash disposal pits ("A" & "B"). <br />The necessity for this permit modification stems from an engineering evaluation of the <br />remaining versus the required overburden (spoil materials from the LTSA) volumes. The <br />evaluation was initiated by BEKlTen•anext, and finalized by Tetra Tech EM Inc. (The <br />engineering firm change resulted from the transition of contracted personnel from one <br />organization to another.) While this study was refined over atwo-year period, the final <br />determination is that the LTSA contains approximately 77,000 bank cubic yazds (bcy) of <br />overburden material in excess of the amount necessary to complete the reclamation work <br />in B-Pit. <br />Since Section 2.05.4 of the Permit indicates that "major disturbed areas will be returned <br />to their "approximate original contour", CEC proposes that the approximate original <br />contour be raised vertically by 2.75± feet across the LTSA, and blended at the perimeter <br />margins in order to minimize the impact to the drainage plan, and to allow for drainage <br />consistent with that plan. When viewed across the entire acreage encompassed by the <br />Permit, CEC believes that this change in elevation will be consistent with the intent of the <br />term "approximate", as used therein. <br />Submitted with this application aze copies (3 each) of the following: <br />- Reclamation Contour and Drainage Plan Map - as Revised - (this is Appendix <br />Q-1 to the Permit, and is updated each year in the Annual Hydrology and <br />Reclamation Report (AHR Report)). Further updates will delete the <br />"Reclamation Contour Proposed 1996/1997" contour lines should this <br />Technical Revision be approved. <br />- Letter dated 08-09-02, from Tetra Tech EMI Inc. to CEC, describing the <br />evaluation, and providing the proposal with respect to the LTSA. (In the letter <br />"LTSP" refers to the same azea as LTSA in this Technical Revision.) <br />CEC is not seeking an adjustment to the bonding amounts with this Technical Revision <br />since the lands subject to this proposed revision are already included in the calculation of <br />"total azea remaining to be reclaimed" (2001 AHR Report, page 123). No new mining <br />activity is proposed by this Technical Revision. Further, the activities proposed by this <br />Technical Revision No. 34 require no placement of dredge or fill material, or any <br />excavation associated with a dredged or fill project, either temporary or permanent, in <br />waters of the United States. <br />The Division's approval of this Technical Revision No. 34, to modify the final contour <br />over the Long Term Spoil Area, is hereby requested. <br />R-~ <br />
