Long <br />Division Direc~o~ <br />THIS PERMIT is issued by the Mined Land Reclamation Board, Departrnent of Natural Resources, <br />State of Colorado. <br />RECITALS <br />A. The Pemtittce, Rio Blanco County, desires to conduct a mining operation lmown as Baxter Pass <br />Gravel Pit, for the purpose of extracting gravel. The Pem3ittee will not mine any secondary commodities at this <br />site. <br />B. On April 12, 2000 the Mined Land Reclamation Board (the "Board") approved the Pemuttee's <br />application for this permit and directed that this permit be issued upon the filing with the Division of Minerals and <br />Geology (the "Division") of performance wartarrty approved by the Division. Said warranty has been filed with <br />the Division. <br />C. h`the Pemrittee desires to extras materials other than those listed in (A), a separate permit may <br />be required. <br />D. On April 12, 2000 the Board made the following findings: <br />1. The application for this pemut complies with the requiremerrts of the Colorado Mined <br />Land Reclamation Act for the Extraction of Constmction Materials, C.R.S. 34-32.5-101 et sew., as amended, and <br />with all applicable local, state and federal laws; <br />2. The operation will not adversely affect the stability of any significant, valuable, and <br />permanent man-made sWcturo located within two hrindred feet of the Affected Land, except where there is an <br />agreement between the Operator and the persons having an irrterest N the structure that damage to the strcture is <br />to be compensated for by the Pemrittee; and; <br />
