prepared using the following assumptions along with the pazameters that you have <br />already identified. <br />-If 1,000,000 cubic yards will be generated over the life of the mine, an overburden <br />stockpile will be necessary until one of the mined areas becomes large enough to start <br />backfilling waste without interfering with the mining process. The assumption that will <br />be used is that this stockpile will be approximately 200,000 yards before backfill can <br />commence. Therefore, a cost for backfilling this material will be added to the estimate. <br />An average haul distance of 1000 feet will be used to calculate this itemized cost. <br />-1,000,000 cubic yazds of material can cover an area of approximately 15 acres to a depth <br />of 40 feet, therefore, another assumption will be that at least 15 more acres will need to <br />be reclaimed to rangeland. This will require additional topsoil replacement and seeding <br />costs equivalent to approximately 3 acres for each phase. Since you have chosen to use <br />the phased bonding approach, this will add the cost for reclaiming 6 additional acres to <br />the total bond. <br />6.4.19 Exhibit S -Permanent Man-Made Structures <br />As identified in our letter of February 26, 2002, any structures within 200 feet of the <br />affected area will need to have a notarized agreement between the applicant and the <br />structure owner for compensation in the event of damage. In lieu of the agreement, an <br />appropriate engineering evaluation that demonstrates such structures will not be damaged <br />by activities occurring at the mining operation maybe submitted. This must be provided <br />prior to consideration of approval. <br />This concludes our review of your preliminary adequacy responses. The decision date <br />for this application is March 29, 2002. Our financial warranty estimate will be completed <br />with the aforementioned assumptions and forwazded to you as soon as it is ready.
