be accelerated if the Division detemtines that there is an imminent threat to persons, property or the environment." <br />2 DMG Stipulation No. 2 (Ground Water Supply)- "The Applicant will comply with state law <br />regazding impacts to ground water as more particularly described in the September 15, 2005 "Response to Reclamation <br />Permit Application" from the Office of the State Engineer to the Division of Minerals and Geology and the conditions <br />contained therein. " <br />3 DMG Stipulation No. 3 (Blasting)- "The Operator will install a frequency responsive seismograph <br />at the Black-Central City Sanitation District (District) Waste Water Treatment Plant. The seismograph will be installed at <br />a location to be approved by the Division of Minerals and Geology (DMG), in cooperation with the District. The <br />seismograph will monitor each quarry development and production blast. Seismograph records must be retained for at <br />least 3 years and be available for inspection by the DMG on demand. Continued access to the Waste Water Treatment <br />Plant by the Operator is necessary for compliance with this permit condition; if the owner(s) of the Plant deny the <br />Operator's access at any reasonable fime for the purpose of seismographic monitoring, the requirement to comply with <br />this permit condition shall be re-evaluated by the Division through submittal of a technical revision by the Operator." <br />The amount of financial warranty set by the Division for this operation is $903,800.00. You must submit a financial <br />warranty in this amount and a performance warranty in order for us to issue a permit. hr the event you have requested a <br />fmancial warranty form, we have enclosed it in this letter, h`you have not, please select a type of financial warranty from <br />Rule 4.3. Then contact us so that we can provide you with the appropriate warranty form. We have enclosed a <br />performance warranty form with this letter for your use. <br />PLEASE NOTE THAT MINING OPERATIONS MAY NOT COMMENCE UNTIL A PERMIT HAS BEEN <br />ISSUED BY THE DIVISION AEiZB RECEII'T OF YOUR FINANCIAL WARRANTY AND PERFORMANCE <br />WARRANTY.
