Cottony <br />Division DIreCIOr <br />Natural Resource Trustee <br />On February 10, 2004, the Division of Minerals and Geology received yow 112 Construction Materials Reclamation Permit <br />Application package for the Tlrnpike Mining Resource, File No. M-2004-009. Preliminary review of the information received <br />determined that the following items must be received before the Division can consider yow application as being submitted and <br />technical review can begin: <br />EXAiRiT R - Prrutf of Filinrr with f'nnnh f'lerk and Recorder ($,~le 6d_7R1~ YOU mUSt Submit an affidavit Oi <br />receipt indicating the date on which the application was placed with the local County Clerk and Recorder, The affidavit <br />or receipt must be dated and signed by the County Clerk and Recorder not the Applicant's Consultant. <br />EXAiRIT C _ Permanent Man-Made Ctnrrh.m_v (Role 6.4_t41~ You must provide information Sufficient [o <br />demonstrate that the stability of any structures located within two hundred (200) feet of the operation or affected land <br />will not be adversely affected (Geotechnical Stability Report) or you need to submit signed agreements with the owners <br />of atl of the stntchttes. <br />Yow application will not be considered submitted until the information listed above is received and found sufficient to begin ow <br />review. A decision date will be established 90 days from the date of receipt of all of the requested information. Additionally, if <br />you have already published notice you will need to republish notice, after the Division considers the application submitted This <br />notice must be published once a week for fow (4) consecutive weeks, starting within ten (10) days of the date yow application is <br />considered submitted. We will notify you when you should initiate republication of yow notice. The final date fw receiving <br />comments is the 20th day after the fourth publication or the next regutaz business day. <br />You have sixty (60) days from the above date to submit all necessary docnmems that the Office nerds for an application to be <br />considered Sled. If, at the end of the sixty day period, the application has not been determined to be filed with the Office, the <br />Office shall deny the application and terminate the application file. <br />This letter shall not be construed to mean that there are no other technical deficiencies in yow application.
